On November 10, 2021, Judge Judith E. Levy, presiding in the United States District Court for the Eastern District of Michigan, granted final approval for a historic $626.25 million settlement arising from class action and individual lawsuits initiated on behalf of over 90,000 Flint residents and businesses. These legal actions targeted multiple governmental defendants, including the State of Michigan, Michigan Department of Environmental Quality (DEQ), and individual defendants such as former Governor Rick Snyder. The lawsuits were brought in response to their roles in rerouting dangerously contaminated water from the Flint River into the City’s water supply in an effort to reduce costs, as well as their subsequent attempts to conceal the crisis.
This ruling signifies that Flint residents are now eligible to receive financial compensation as part of the settlement. A substantial 80 percent of the funds will be allocated to individuals who were under 18 years of age at the time of the crisis, with a significant portion of that sum designated for claims involving children aged 6 and younger. The remaining portion of the funds will be directed towards special education services in Genesee County, as well as adults, business owners, and property owners who suffered property damage.
Legal actions against two private engineering firms, Veolia North America (VNA) and Lockwood, Andrews & Newnam (LAN), on grounds of professional negligence, as well as separate litigation against the U.S. Environmental Protection Agency, are still ongoing in the United States District Court for the Eastern District of Michigan. On August 11, 2021, Judge Levy granted class certification for liability claims in the ongoing litigation against LAN and VNA. Allegations against both companies center around their failure to provide appropriate professional guidance, significantly contributing to the widespread lead contamination of the water supply during the Flint water crisis. A trial for these matters is tentatively scheduled for October 2023.
