- the affected portfolio consisted of approximately $500 million in loans and represented nearly 23% of all CCBX loans;
- the deterioration exposed Coastal to significant losses despite the purported credit protection provided by the partner’s indemnification agreement; and
- as a result, Defendants’ statements regarding Coastal’s business, operations, financial condition, and credit risk were materially false and/or misleading and/or lacked a reasonable basis.
