What Is the Eagle Pharmaceuticals, Inc. Class Action Lawsuit About?

Bronstein, Gewirtz & Grossman, LLC notifies investors that a class action lawsuit has been filed against Eagle Pharmaceuticals, Inc. (“Eagle Pharmaceuticals” or “the Company”) (NASDAQ: EGRX) and certain of its officers.

Class Definition:
This lawsuit seeks to recover damages against Defendants for alleged violations of the federal securities laws on behalf of all persons and entities that purchased or otherwise acquired Eagle Pharmaceuticals securities between August 8, 2023 and November 28, 2023, inclusive (the “Class Period”). Such investors are encouraged to join this case.

Case Details:
The Complaint alleges that throughout the Class Period, Defendants made materially false and/or misleading statements, as well as failed to disclose material adverse facts about the Company’s business, operations, and prospects. Specifically, Defendants failed to disclose to investors: (1) that the Company was experiencing slower-than-anticipated pull-though from a wholesale customer predominantly due to expiry of inventory; (2) that, as a result, the Company had overstated its revenue; (3) that the Company did not have effective internal controls and procedures over financial reporting as to PEMFEXY sales; and (4) as a result of the foregoing, Defendants’ positive statements about the Company’s business, operations, and prospects were materially misleading and/or lacked a reasonable basis.
